Powers of attorney are not required in Canada. Apart from the usual information and documents, our foreign associates are reminded to also specify/provide the following when instructing us to file Canadian applications:

Patent

  • whether examination is to be requested upon filing
  • if the applicant is not the inventor, the basis for the applicant’s ownership of the invention/patent rights
  • if the publication was not in English or French, a translation of the application into one of those languages

Trademark

  • list of specific wares and services (rather than an identification of classes)
  • whether the trademark has been used in Canada for each ware and service, and if so, the date of first use in Canada
  • if the publication was not in English or French, a translation of the application into one of those languages

Industrial Design

  • what particular features, if any, are considered to be distinctive
